What happened

The European Union has begun enforcing transparency obligations under its AI Act, requiring companies to clearly disclose when users are interacting with AI systems and when content has been AI-generated. The rules took effect on August 2nd and apply to providers and deployers of AI systems operating within the EU market. The regulations cover chatbots and other AI applications that interact directly with users, as well as AI-generated text, images, audio, and video content. Enforcement mechanisms include fines up to €35 million or 7% of global annual turnover, whichever is higher, for violations involving prohibited practices.

What it means for your business

If your company serves customers in Europe or targets EU markets, these rules likely apply to you regardless of where your business is based. Any customer-facing AI tool—chatbots, automated email responses, AI-generated social media content, or AI-assisted product descriptions—now requires visible disclosure that users are interacting with AI. This means reviewing your websites, apps, and communication channels for AI touchpoints and adding clear labels or notices where needed. Non-compliance carries substantial financial penalties, making this a compliance matter rather than a discretionary choice.
